Memo on Bill A01174

PURPOSE  OR GENERAL IDEA OF BILL: To establish a constitutional right to       
privacy, to establish a children`s bill  of  rights,  and  to  repeal  a       
provision  of  the  state  constitution  which  requires courts to place       
children in the custody of persons of the same religious persuasion.           
                                                                               
SUMMARY OF SPECIFIC PROVISIONS: Amends article 1 and repeals section  32       
of article 6 of the New York State Constitution.                               
                                                                               
JUSTIFICATION: Currently there is no provision in the state Constitution       
expressly  guaranteeing a right to privacy.  This provision incorporates       
a privacy right in the constitution. This amendment will also  recognize       
the  rights  and special needs of children.  Its provisions are based on       
recommendations advanced by a United Nations taskforce on this  subject.       
Section  32  of  article  6 of the constitution should be deleted in the       
recognition that the placement  of  children  for  adoptions  should  be       
guided by the overall best interest of the child.

EFFECTIVE  DATE:    Resolved  (if the Senate concur), That the foregoing
